When you have problems with the IRS or CA Franchise Tax Board, it can be emotional. You want to get help but you don’t know where to look first. Before you pay any company anything, DO YOUR RESEARCH!!! Don’t give any firm any of your hard earned money. First of all, I just want to say to stay away from the big tax relief companies like Optima Tax Relief, Tax Relief Advocates, Tax Rise, etc… Any firm that you hear on TV or radio ads. They are called OIC Mills. Short for Offer in Compromise Mills. They are often on the IRS’ “Dirty Dozen” list of tax scams. They promise that they can lower your tax when it reality they can’t and only a small percentage of people in financial hardship can get an Offer in Compromise.

Next, you want to Google the company you want to work with. Preferably someone local to you. Look at all of their reviews. BBB, Google, Yelp, etc… Yelp and BBB are not really great for reviews but they will tell you about the complaints. These complaints are real. Read them. Do your research. Also do an AI search for them. AI is not accurate but it will tell you an overall summary about the company and reviews and complaints.

Find out what they charge you for and why. Tell them to itemize it so you can see what you’re paying for. Most big companies use a percentage of what the taxpayer’s balance is. They don’t even care what you can qualify for. A monthly installment agreement to pay off the entire balance or a hardship program that you can qualify for. But research every company you may want to use because even small tax relief companies will do that.

Ask them if they are an Enrolled Agent, CPA, or Tax Attorney. These are the only tax professionals that can represent you with the IRS. If they’re just tax preparers, they have limited authority and CANNOT help you with an IRS Fresh Start Program resolution or with any state resolution. Many tax preparers like to say that they can help with tax relief and tax resolutions when in reality, they cannot.
